When I analyzed the initiative, I neglected to look into section 40 in great detail.

It turns out the Idaho code commission has no such power. They are only responsible for making compilations of the Idaho code and issuing pocket parts as necessary each year after the session, but they have no power to make laws, or write so-called repealer statutes. That is not what they are empowered to do at all.

Thank you, Art! That makes me wonder then who decides which existing statutes are 'inconsistent' with Prop 1?

It has to be done either by a court plaintiff, a candidate making an election challenge, or the legislature itself, deciding to change the law.

As to the first, I don’t know how an ordinary elector would have a cause of action, but there could be a class action on behalf of all voters.

Great summary. How do we get low-information voters to stop listening to the radio and TV ads and start thinking about how destructive this proposition will be to Idaho? (Many don't care, but some are genuinely swayed by the lies they're hearing.)
